1. ACCEPTANCE OF TERMS

Welcome to Bisou Match! These Terms of Service ("Terms") are a legal agreement between you and Bisou Match Inc. ("Bisou," "we," "us," or "our"). By accessing or using our platform, you agree to these Terms.

If you don't agree, you cannot use our service.

1.1 Related Policies

These Terms work with:

1.2 Eligibility

To use Bisou Match, you must:

• Be at least 18 years old (or 19 in BC, NB, NL, NT, NS, NU, YT)

• Not be prohibited from using the service under applicable law
• Comply with all local laws

2. ACCOUNT REGISTRATION

2.1 Account Creation

You must provide:

• Accurate, current, and complete information
• Valid birth data (date, time, place) for Vedic astrology calculations
• Your real name and age
• A valid email address

You agree to:

• Keep your password secure
• Update your information as needed
• Notify us of unauthorized account access
• Not share your account with others

2.2 Account Verification

Failure to verify may result in account suspension.

2.3 One Account Per Person

You may only create one account. Multiple accounts will be terminated.

3.2 Vedic Astrology Calculations

Important Disclaimers:

• Astrological compatibility is for entertainment purposes
• We do not guarantee matches will lead to relationships
• Astrology is not science and should not be relied upon for major life decisions
• Birth chart accuracy depends on accurate birth information you provide
• Different astrological systems may produce different results

3.3 We Are Not a Dating Guarantee

We provide a platform to meet people. We do not:

• Guarantee you will find a match
• Guarantee compatibility or relationship success
• Conduct background checks on users (unless specified)
• Verify all user information (though we try)
• Guarantee safety of in-person meetings

You are responsible for your own safety and decisions.

4. USER CONDUCT

4.1 Prohibited Activities

You may not:

• Contact, solicit, or interact with minors
• Harass, threaten, stalk, or intimidate anyone
• Share others' private information without consent
• Coordinate illegal activities

Profile Violations:

• Provide false information (especially age)
• Use photos that aren't you
• Impersonate others
• Create fake or spam accounts

Platform Abuse:

• Scrape, copy, or automate interactions with our service
• Reverse engineer or hack our platform
• Spam, advertise, or promote other services
• Sell or transfer your account

Content Violations:

• Post sexual, violent, or hateful content
• Share child sexual abuse material (CSAM)
• Violate intellectual property rights
• Post spam or malware

Commercial Violations:

• Solicit money or financial information
• Promote products or services
• Use the platform for prostitution or trafficking

4.2 Consequences

Violations result in:

• Warning or temporary suspension
• Permanent account termination
• Report to law enforcement (for illegal activity)
• Legal action

5. CONTENT

5.1 Your Content

You retain ownership of content you post (photos, messages, profile information).

By posting, you grant us:

• Worldwide, non-exclusive, royalty-free license
• Right to use, display, modify, and distribute your content
• Right to use for service operation, marketing, and improvements
• Sublicense rights to service providers

This license ends when you delete content or your account, except:

• Content shared with others may remain visible to them
• We may retain copies for legal/operational purposes
• Anonymized data may be used indefinitely

5.2 Prohibited Content

Do not post content that:

• Violates laws or third-party rights
• Is false, misleading, or fraudulent
• Contains nudity or sexual content
• Is hateful, violent, or harassing
• Involves minors inappropriately
• Infringes intellectual property

5.3 Our Content

All platform content (design, logos, text, software) is owned by Bisou or our licensors. You may not:

• Copy, modify, or distribute our content
• Use our trademarks without permission
• Create derivative works

6. SUBSCRIPTIONS AND PAYMENTS

6.1 Free and Paid Features

• Free Tier: Basic matching and limited features
• Premium Subscriptions: Enhanced features, unlimited matches, advanced insights

6.2 Subscription Terms

Auto-Renewal:

• Subscriptions automatically renew unless canceled
• You'll be charged at the then-current rate
• Cancel anytime in account settings

Billing:

• Charges are made in advance
• Payment methods: credit card, debit card, in-app purchases
• All fees are in USD/CAD/EUR/GBP based on your location

6.3 Refund Policy

General Rule: All sales are final. No refunds except:

• Required by law
• Service unavailability for extended periods
• Billing errors

Cancellation:

• You can cancel anytime (no refund for current period)
• Access continues until the end of paid period
• No partial refunds for unused time

6.4 Price Changes

We may change prices with 30 days notice. Continued use after changes constitutes acceptance.

6.5 In-App Purchases

• Purchases through app stores are subject to their terms
• Refund requests should be directed to the app store
• We cannot process refunds for app store purchases

7. COMMUNICATION

7.1 Platform Messages

You agree we may send you:

• Account updates and security alerts
• Changes to Terms or policies
• Customer support responses

You cannot opt-out of essential service communications.

8.3 DMCA Takedown

If you believe content infringes your copyright:

• Include: description of work, location on our platform, your contact info, good faith statement
• We'll review and may remove infringing content

9. DISCLAIMERS

9.1 Service "As Is"

Bisou Match is provided "as is" and "as available" without warranties of any kind. We disclaim:

• Implied warranties of merchantability and fitness
• Accuracy, reliability, or completeness
• Uninterrupted or error-free service
• Security or safety guarantees

9.2 Astrological Disclaimer

Vedic astrology is for entertainment.

• Not a substitute for professional advice
• Not scientifically validated
• Should not be relied upon for major decisions
• Results vary based on interpretation

9.3 User Interactions

We are not responsible for:

• User conduct or content
• Accuracy of user profiles
• Safety of in-person meetings
• Outcomes of relationships

Meet safely. Use common sense.

9.4 Third-Party Services

We're not responsible for third-party services (payment processors, social media integrations, etc.).

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

10.1 No Liability For

• Indirect, incidental, or consequential damages
• Lost profits, data, or opportunities
• Personal injury or property damage
• User conduct or content
• Service interruptions or errors

10.2 Liability Cap

Our total liability is limited to the lesser of:

• $100 USD
• Amount you paid us in the past 12 months

10.3 Exceptions

Some jurisdictions don't allow liability limitations. Where prohibited, these limits may not apply.

11. INDEMNIFICATION

You agree to indemnify and defend Bisou from claims arising from:

• Your use of the service
• Your content
• Your violation of these Terms
• Your violation of others' rights
• Your interactions with other users

This includes legal fees and costs.

12. TERMINATION

12.1 By You

You can delete your account anytime in settings.

12.2 By Us

We may suspend or terminate your account:

• For violating these Terms
• For suspicious or fraudulent activity
• For extended inactivity
• If required by law
• At our discretion with 30 days notice

12.3 Effect of Termination

Upon termination:

• Your access ends immediately
• We may delete your data (per Privacy Policy)
• Outstanding fees remain due
• Certain provisions survive (liability, indemnification, disputes)

13. DISPUTE RESOLUTION

13.1 Governing Law

• United States Users: Delaware law (excluding conflict of law rules)
• Canadian Users: Laws of the province where you reside
• EU/UK Users: Laws of your country of residence

13.2 Arbitration (US Users Only)

Disputes must be resolved through binding arbitration under AAA rules, except:

• Small claims court (under $10,000)
• Intellectual property disputes
• Injunctive relief

No class actions. Disputes must be brought individually.

Opt-Out: Email support@bisoumatch.com within 30 days of account creation.

13.3 Jurisdiction (Non-US Users)

• Canadian Users: Courts of your province
• EU/UK Users: Courts of your country

14. GENERAL PROVISIONS

14.1 Changes to Terms

We may update these Terms. Changes are effective:

• Immediately for non-material changes
• 30 days after notice for material changes
• Continued use after changes constitutes acceptance

14.2 Entire Agreement

These Terms, Privacy Policy, and Child Safety Policy constitute the entire agreement.

14.3 Severability

If any provision is invalid, the rest remains in effect.

14.4 No Waiver

Our failure to enforce a right doesn't waive it.

14.5 Assignment

We may assign these Terms. You may not without our consent.

14.6 Force Majeure

We're not liable for delays or failures due to events beyond our control (natural disasters, wars, pandemics, etc.).

14.7 Language

If translated, the English version controls in case of conflicts.

15. CALIFORNIA-SPECIFIC RIGHTS

California Residents:

• You may have additional rights under California Civil Code Section 1789.3
